Compliance and Prevention
Dispute Resolution
We promote individual accountability to create positive impacts within the work environment.
The employer is responsible for developing and implementing workplace conflict policies and procedures and creating and managing dispute resolution programs.
It sometimes involves resolving disputes within teams but also with clients or external collaborators.
Our team helps organizations become efficient by transforming their management practices.
Collaborative dispute management
Dispute prevention and resolution (DPR) methods prevent or resolve misunderstandings, problems, oppositions or conflicts.
Their use is voluntary and must be mutually agreed upon by the parties involved. These methods generally encourage the cooperation and participation of the parties so that they can find satisfactory solutions for all.
We assist you in setting up the necessary structure and environment for these discussions.
Mediation and the Role of the Mediator
Mediation is an "assisted" negotiation.
This voluntary process involves the intervention of a neutral and impartial third party, who is chosen internally or externally to ensure the satisfaction of both parties.
The mediator works with the parties to structure the negotiation, maintain communication channels, clarify the issues, help them express their needs and generate alternative ideas for resolving the dispute (or claims).
Ultimately, the mediator helps the disputing parties reach a mutually satisfactory solution to the issues at hand.
The mediator has no decision-making authority and cannot impose a resolution on the parties.
Arbitration as a last resort
Arbitration is an alternative legal procedure to the courts when negotiations and mediation fail.
The disputing parties appoint one or more arbitrators to review the evidence and arguments and issue a binding decision called an “arbitration award.”
We assist you in preparing and managing this stage.
